PTAB Orders on Settlement
These notes cover how AIA trials end by settlement under 35 U.S.C. § 317 and § 327: filing the agreement, requesting termination, and the Board's discretion to proceed.
Parties may settle an AIA trial at any stage. Under § 317 the settlement agreement must be filed with the Office, and estoppel does not attach to a petitioner whose trial ends in settlement before a final written decision. After institution, the Board may still decide to proceed to a final decision.
Designations and rules change. Before relying on any decision, confirm its current status on the USPTO PTAB pages.
