PTAB Scheduling Orders
A scheduling order sets the due dates for an AIA trial after institution. These notes explain what such orders contain and which dates parties may move by agreement.
Every instituted trial gets a scheduling order that works backward from the statutory deadline for a final written decision. Parties may stipulate to move some intermediate dates, but not the dates that protect the statutory timeline.
Designations and rules change. Before relying on any decision, confirm its current status on the USPTO PTAB pages.
