Informative PTAB Decisions
An informative decision illustrates how the Patent Trial and Appeal Board handles a recurring issue but does not bind later panels. These notes cover decisions grouped as informative; designations change, so confirm current status with the USPTO.
Informative decisions give guidance on Board norms without binding later panels. Many in this group concern discretion to deny institution under 35 U.S.C. § 325(d) when the same or substantially the same art or arguments were already before the Office, and some were later elevated to precedential status or replaced by newer guidance.
Designations and rules change. Before relying on any decision, confirm its current status on the USPTO PTAB pages.
